Moon Over Eldorado Canyon State Park

When people think of Colorado they think of the Rocky Mountains in Larimer, Grand, and Boulder Counties. Or maybe they think of hitting the black diamond runs in Garfield or Summit County or possibly catching a Broncos or Rockies game in the heart of Denver County. Denver is home to people living in not just large cities like Denver and Denver Springs, but also tourist destinations like Vail, and smaller towns and cities like Ouray or Silverton.

Thanks to the stunning vistas and a strong state economy, more and more people are flocking to the Centennial State, especially the city of Denver. Unfortunately, the population demand and limited supply of affordable housing makes Denver one of the most expensive states in which to live. And with these high living costs, many individuals end up needing to file for bankruptcy to relieve some of their burden of debt.

Residents of Jefferson County, Park County, Gilpin County, Douglas County, and other Colorado communities don’t have many affordable options when selecting a bankruptcy attorney. Bankruptcy can be costly at a time when Coloradans can least afford extra expenses. That’s why our Denver bankruptcy attorneys offer a low flat fee for residents looking to use Chapter 7 or Chapter 13 bankruptcy to get out from under a mountain of debt.

Please don’t mistake our low fee as an indicator of sub-standard service. As your Denver county area bankruptcy lawyer handles your case, you can talk to them at any time without having to worry about additional costs. Our team of experienced legal professionals treats every client like their only client. Your affordable flat fee includes everything, so you don’t have to worry about unforeseen expenses down the road, while still getting the full, 5-star legal experience you need.

How Much Does it Cost to File Bankruptcy in Denver?

Debt Reduction Road Sign

First things first-  Before you can file for bankruptcy in Denver, you must take a Debtor Education course. This will most likely be the first cost you accrue when filing for bankruptcy. Additionally, once you have completed the Meeting of the Creditors during your bankruptcy case, you will be required to take an additional class known as a Credit Counseling Course.

These courses can range from $0 to $500 each depending on where they are taken. Your CO bankruptcy attorney can help you find an affordable option for both of these mandatory courses.

Once you’ve taken your Debtor Education class, the next fee associated with filing for bankruptcy is due as soon as you file the Schedules. The fee for a bankruptcy filing will of course depend on whether you file for a Chapter 7 bankruptcy or a Chapter 13 bankruptcy.

The flat rate charged by the Federal Bankruptcy Court for a Chapter 7 bankruptcy is $338. All Chapter 7 fees must be paid before the filing of the bankruptcy petition. Attorneys that accept payments for attorney’s fees after the filing of a Chapter 7 bankruptcy are violating the automatic stay and discharge injunction provisions of the Bankruptcy Code. This is because attorney’s fees owed in a Chapter 7 case are no different than any other dischargeable, pre-petition debt – that is, they are discharged and cannot be collected once the case is filed.

The flat fee for filing a Chapter 13 bankruptcy in Denver will cost $313.

If you’re unable to afford these fees, you can ask the court for permission to pay off the amount through installment payments. Rarely, the court will waive the filing fee if your income falls below the poverty line and you cannot afford payments.

It’s important to note that these flat fees don’t include additional services you may require when filing for bankruptcy in Denver. For example, any adversary proceedings during your petition can cost extra, as well as if you need to convert your filing from Chapter 7 to Chapter 13 (and vise versa) after you’ve already submitted the bankruptcy schedules. Our Denver debt relief attorneys understand that deciding to file for bankruptcy is never easy, which is why we offer inexpensive flat fees that suit any budget and allow you to enter into this process knowing what to expect.

How much will it cost you to file for bankruptcy? Contact us today for a free consultation and find out. Much depends on the nature of your case. If your case is simply, the flat fee will be less. If your case is complex because you own a lot of assets or for some other reason, the fee will be more.

Can I Save Money By Filing Bankruptcy Without a Lawyer in Denver?

Making the decision to file or not to file for bankruptcy can be a tough choice. It can be easy for an already financially strapped person to talk themselves into “saving” money by choosing to file for bankruptcy without the help of an experienced Denver County bankruptcy attorney.

If you are looking for the cheapest way to file for bankruptcy, you can file pro se or without an attorney. However, we strongly recommend against it.  Bankruptcy is a complicated process, and if any of the paperwork or procedures are incomplete or inaccurate, you don’t get the benefit of a do-over. While you may save yourself a nominal fee up-front from not paying for an attorney, it may cost you much more in the long run.

When you file a bankruptcy case by yourself, you are held to the same standards as an attorney.  Pro Se bankruptcy filers often misunderstand all the bankruptcy documents which need to be filed and by what date, which often results in the dismissal of their bankruptcy case for failure to timely file certain documents. Furthermore, most non-lawyers aren’t familiar with Colorado’s extensive exemption list, which may result in the loss of assets in a Chapter 7 bankruptcy case, which would have been avoided if Denver bankruptcy attorney had been retained.

So before you decide to file for Chapter 7 or Chapter 13 bankruptcy Pro-se, add up the amount of time you’ll spend compiling paperwork that could’ve been spent working or spending time with your family, as well as the possible loss of your car, tools, or family heirlooms that might get left out of your exemptions and see if it’s worth the peace of mind that comes with paying the low flat rate fee our experienced Denver debt relief attorneys charge to handle the case for you.

Additionally, it’s also worth mentioning that filing for bankruptcy pro se is NOT free. You must still pay all of the associated fees to the court, as well as cover the cost of the credit counseling and debt education courses.
